Subject of the Agreement:

The subject of this agreement is the sale and delivery of the products/services that the BUYER orders electronically from the Hercules (herculesfightgear.com) website with the characteristics specified in the agreement. Additionally, this agreement defines the rights and obligations of the parties in accordance with the Turkish Consumer Protection Law No. 6502 and the Regulation on the Procedures and Principles for Distance Contracts. The BUYER acknowledges and declares that they have been informed about the basic characteristics of the products/services for sale, the sale price, payment method, delivery terms, etc., and have electronically approved this information before placing an order. The preliminary information and invoice on the Hercules (herculesfightgear.com) payment page are integral parts of this agreement.

Date of the Agreement:

This Agreement is deemed to be completed on the date it is electronically approved by the BUYER on the relevant website, and a copy of the agreement will be sent to the BUYER's specified email address.

If there is no delivery branch of the carrier at the BUYER's place of residence, the product will be picked up from another nearby branch as notified to the BUYER.

Service Delivery, Performance of the Agreement, and Delivery Terms:

The products specified above will be delivered to the address specified in the agreement within 5 business days if available in stock at the time of order. Otherwise, the delivery of the product within the legal maximum period of 30 days will be considered as timely delivery.

If the payment for the purchased product cannot be collected for any reason or if the payment is canceled or if there is a technical reason preventing access to https://herculesfightgear.com/tr, Hercules will be exempt from the obligation to deliver and provide services for this period.

Hercules shall not be held responsible for delays or failure to fulfill obligations due to technical infrastructure failures, internet outages, malfunctions, speed reductions, security issues, general power outages, adverse weather conditions, wars, terrorist acts, embargoes, natural disasters, fires, floods, emergencies, cyber-attacks, virus infections, uprisings, strikes, bans imposed by administrative and legal authorities, access restrictions, or other force majeure or unforeseen events and/or disruptive conditions beyond Hercules's reasonable control.

Such circumstances shall not be considered as delays, partial performance, or default by Hercules, and no compensation may be claimed from Hercules for these conditions.

Right of Withdrawal:

The BUYER has the right to withdraw from the agreement without any legal or penal liability and without providing any reason within 14 (fourteen) days from the delivery of the product or the signing of the agreement. The SELLER undertakes to accept the return of the product upon receipt of the withdrawal notice. Withdrawal notices and other notifications related to the agreement can be sent through the SELLER’s contact information provided above.

To exercise the right of withdrawal, the BUYER must notify the SELLER in accordance with the regulations within this period. In the case of withdrawal:

The product delivered to the BUYER or a third person specified by the BUYER must be returned.

Products to be returned within 14 (fourteen) days must be delivered in their original box, packaging, and with any standard accessories or additional products provided with the product, in a sound and undamaged condition. The product price will be refunded in the same manner within 10 (ten) days following the exercise of the right of withdrawal and receipt of the information. The original invoice provided to the BUYER during delivery must also be returned with the product. The cost of return shipping is borne by the SELLER.

For purchases made from https://herculesfightgear.com/tr, the BUYER has the right to withdraw from the distance selling agreement within 14 days. Custom orders or personalized products (e.g., size changes or custom texts) will not be accepted for return. The product must be in perfect and unused condition. Products that are scratched, damaged, or have undergone physical changes will not be accepted for return. If no damage or changes are found by our experts, the return process will be initiated. Returns and exchanges should be sent with the order number and return/exchange request to support@herculesfightgear.com. Returns and exchanges will only be processed for products purchased from https://herculesfightgear.com/tr. The returned product must be sent with its packaging, certificate, label, invoice, and any promotions if applicable.

Consumer Complaints Resolution Path and Contact Information:

The BUYER can send complaints about services and personal data to support@herculesfightgear.com. Additionally, complaints and objections regarding goods/services can be made to the Consumer Arbitration Board or Consumer Court in the BUYER's place of residence, within the monetary limits announced annually by the Ministry of Customs and Trade.

Protection of Personal Data:

Hercules processes personal data in accordance with the Turkish Personal Data Protection Law No. 6698 (KVKK), including processing, transferring, storing, classifying, and profiling. By accepting this distance selling agreement, the BUYER consents to the processing, transfer, storage, classification, and profiling of their personal data in this context. As a "Data Subject," the BUYER has the right to learn whether their personal data is processed, request information about the processed data, learn the purpose of processing and whether it is used appropriately, know the third parties to whom the data is transferred, request correction of incomplete or incorrect data, request deletion or destruction of data under legal conditions, and request that corrections, deletions, or destructions of data be notified to third parties to whom the data has been transferred. The BUYER also has the right to object to results that are solely based on automated processing that affect them adversely. Complaints and requests regarding these rights can be made in writing to support@herculesfightgear.com or through other methods determined by the Personal Data Protection Board.

Hercules will respond to requests related to the processing, transfer, and/or storage of personal data within 30 (thirty) days, free of charge, and according to the nature of the request. The request must be made in writing or through other methods determined by the Personal Data Protection Board. If Hercules rejects the request, provides an insufficient response, or fails to respond within the period, the BUYER may file a complaint with the Personal Data Protection Board within 30 (thirty) days of learning of the response or within 60 (sixty) days of the application.

Protection of Personal Data and Privacy:

The rules and terms regarding the protection, privacy, processing, use, and communication of information on Hercules’s website are as follows:

Necessary measures to ensure the security of information and transactions entered by the BUYER are taken within the SELLER's system infrastructure according to existing technical capabilities. However, since the information is entered from the BUYER's device, the responsibility for protection from unauthorized access, viruses, and similar harmful applications lies with the BUYER.

The BUYER acknowledges that the personal data provided for this order through Hercules and information obtained during membership and purchases on Hercules will be transferred to IKAS PAY, a payment service provider approved by the Banking Regulation and Supervision Agency (BRSA), and that all data related to the payment system will be shared with this service provider. This data may also be transmitted to relevant authorities and courts as required by law.

Applicable Law and Jurisdiction:

In disputes arising from this agreement, Turkish Courts will have jurisdiction and Turkish Law will apply. For disputes within the monetary limits announced annually by the Ministry of Customs and Trade, the Consumer Arbitration Boards in the BUYER's place of residence will be authorized, and for disputes exceeding this limit, the Consumer Courts in the BUYER's place of residence will be authorized.

Miscellaneous Provisions:

The invalidity, legality, or unenforceability of any provision in this Agreement shall not affect the validity and enforceability of the remaining provisions of the Agreement.

Effective Date:

This 12 (twelve) article Agreement has been read and accepted by the Parties and will enter into force from the moment it is electronically approved by the BUYER
